Abstract

The article reviews the law-sociological research in post-stalin, perestroika and post-socialist periods of the country’s development. Particular attention is paid to the modern period, which is interpreted as still transitive and in this context – post-socialist. By characterising the current state of research the author points out that Russian sociology of law could not be institutionalised as a law discipline. But it doesn’t mean yet, that it is an independent branch of sociological knowledge. To form the sociology of law as a sociological discipline it is necessary to formulate such concept of law, which would allow to comprehend the main source of social-legal tension, associated with the opposition between freedom and power arbitrariness, and also to inscribe this concept of law in such sociological concept of Russian society, which would correspond to the certain logic of historical development, contain a model of the desired future and point out real ways of overcoming the current coalescence of power and proprietary, that is blocking the progress towards such future.
